Public hearings

  • Czub subdivision (Tax Map #41.-1-53.11). Surveyor Brian Holbritter presented the 2.15-acre one-lot subdivision from a 117.5-acre parcel owned by James Czub in an R district at 183 Northline Drive. There was no public comment.
  • Kingsley Arms subdivision (Tax Map #31.-2-20). Surveyor Brian Holbritter presented the one-lot 2.05-acre subdivision with a 12-unit, two-story apartment house from a 6.76-acre parcel in an HC district on NYS Route 40. There was no public comment.

Regular meeting (7:00 PM)

Members present: Frank Alessandrini (Chairman), Kasey Casas, Dan Clow, Elizabeth Hale, Vince Ragone, and Bob Weir. Absent: Chris Reynolds. Austin Scarborough, Attorney, was present. The Board approved the November 7, 2024 minutes (Casas · Clow · all).

Applications

  • Genesis Burial Vault — Special Use Permit & site-plan review (Tax Map #41.-1-61). Applicant and business owner David Baker did not appear.
  • Czub subdivision (Tax Map #41.-1-53.11), 183 Northline Drive. The Board had reviewed the application and short-form EAF in October with no issues, and the $180 fee was received. The Board granted preliminary approval (Hale · Clow · all) and final approval (Weir · Ragone · all).
  • Kingsley Arms subdivision (Tax Map #31.-2-20), NYS Route 40. Having reviewed the application and issued a SEQR negative declaration in November, the Board granted preliminary approval (Weir · Ragone · all) and final approval (Ragone · Clow · all).
  • Acker/Paul subdivision — pre-filing conference (Tax Map #57.-2-10.316). Surveyor Brian Holbritter proposed a 3.5-acre one-lot subdivision from a 20.06-acre parcel in an R district at 95 Skyline Drive, owned by James Acker Jr., with Dominick Paul as applicant. Mr. Paul and Mr. Acker’s daughter would like to build a residence on the new lot, served by a 30-foot driveway, with a 50-foot driveway to the existing Acker residence; 16.56 vacant acres would remain. Federal wetlands on the property are an acceptable distance from the project, and the percolation test and septic design are in progress; construction is not planned until spring. The Board will consider SEQRA in January. (The Board issued a negative SEQR declaration at its January 8, 2025 meeting.)
  • ASD Solar II and III (Tax Map #21.-2-5 and #21.-2-4.2). Jason Dell, P.E., of Lansing Engineering submitted amended surveys for both projects. Reviewing the changes, the Board noted the landfill-site pond will be excluded from the fenced area, along with fence relocations and realignment, a section of relocated solar panels, and a reduced number of panels. The Chairman will confirm the modifications with Mr. Dell.

Enforcement of special use permits

The Chairman raised special use permits that applicants have not honored, noting that several have ignored the stipulations in their written decisions — citing Constable Tree, Re-Model Now, and Clemente Small Engines as businesses that have not complied with the contingencies in their Notices of Decision. The Chairman and Town Attorney David Brennan brought the non-compliance to the Town Board, which agreed that code enforcement needs to be implemented. The Board will review the Zoning Code’s provisions on special use permits and their revocation for discussion in January.

Because the first Wednesday of January is New Year’s Day, the next meeting will be held January 8, 2025. The Board adjourned at 7:34 p.m. (Casas · Ragone · all).
