The Zoning Board of Appeals of the Town of Schaghticoke met at the Town Hall, 290 Northline Drive, Melrose, on Thursday, August 1, 2024.

Regular meeting — 7:00 PM

Roll call took place.

Present: Rich Geddis, Kristin Griswold, Lettie Saheim, and Jay Shover. Absent: Ed McDonough (Chairman). Austin Scarborough, Attorney, and Elizabeth Hale, Clerk, were present. In the Chairman’s absence, Jay Shover acted as Chairman.

The Board approved the July 11, 2024 minutes (Griswold moved, Geddis seconded; Saheim abstained, having been absent that month).

Application #1-24 — Malm subdivision (1171 & 1177 NYS Route 40)

John Malm, applicant and executor of his mother’s estate, appeared with his brother, William, to submit an application, short-form EAF, survey, and the $150 application fee for area variances needed before a subdivision can go to the Planning Board. The 2.99± acre parcel (Tax Map #41.-1-20) sits in the Residential Agricultural district and holds two roughly 50-year-old houses; the applicant’s brother lives in one of them and wishes to remain there. The plan is to divide the parcel into a 1.81± acre southerly lot and a 1.13± acre northerly lot, each keeping one dwelling, so the other residence can be sold.

The application seeks a 10-foot side-yard variance for the proposed southerly lot and variances to meet the Zoning Code’s minimum lot density. Each house has its own well but the two share a septic system; the applicant reported that a new septic system has been designed and a percolation test completed, and that he awaits Rensselaer County Health Department approval. Acting Chairman Shover reviewed the public-hearing sequence with the applicant.

The Board scheduled a public hearing on Application #1-24 for its next meeting, September 5, 2024 at 7:05 p.m. (Geddis · Griswold · all).
