Regular meeting
Called to order at 7:30 P.M. by Chairman Ed McDonough. Present: Rich Geddes, Kristin Griswold, Jason Shover, Lettie Saheim, Ed McDonough, and Attorney Kristin Pratt.

Floodway variance discussion — 317 River Bend Road, Pleasantdale (Tax Map area)
The owner of property at 317 River Bend Road, Pleasantdale appeared to discuss an application pertaining to that parcel. He is seeking an area variance, as well as a variance to build within 100 feet of the Hudson River. Chairman McDonough and Kristin Pratt explained that they reviewed the FEMA maps with the Town Code Enforcement Officer, and the property appears to be partially located within the FEMA floodway, with another portion in the flood plain; the owner had been under the impression that the property was in the flood plain but not the floodway. Attorney Pratt advised that she had consulted the Town’s consulting engineer, but that an escrow is required before that engineer can complete any work on the application. The Chairman and Attorney Pratt advised that a hydraulic engineering analysis is required before the Board can move forward, given the preliminary determination that the property is partially in the FEMA floodway under Code Section 69-15. The owner was advised that he may obtain an engineering analysis at his own expense depicting the FEMA boundaries if he disagreed with the preliminary determination.
It was noted that the owner of the neighboring lot had presented a similar application at the February meeting. After consulting an engineer on the hydraulic analysis needed to demonstrate a “no-rise” condition, that neighbor estimated the engineering study would cost more than $20,000 with unknown results, and therefore withdrew his application. Chairman McDonough told the current inquirer that he could collect his application fee at the Town Hall, as the Town would not charge him in light of the withdrawal.
