Office of the Zoning Board of Appeals, Town of Schaghticoke — January 6, 2022. The Board met via Zoom videoconference under the 2021 amendments to the New York State Public Officers Law. Deputy Town Attorney Kristin Pratt explained the Zoom procedure, noting the meeting notice was published in the Troy Record, that the meeting was being recorded and would be posted to the town website and transcribed later, and that minutes were being taken.

Regular meeting

Chairman Ed McDonough opened the meeting at 7:31 p.m. with roll call. Present: Ed McDonough (Chairman), Rich Geddis, Kristin Griswold, Lettie Saheim, and Jason Shover. None absent. Deputy Town Attorney Kristin Pratt and Clerk Elizabeth Hale were present, along with a town resident.

Flood plain construction inquiry — River Bend Road

Chairman McDonough reported an inquiry from the owner of property at 330 River Bend Road, who proposes to construct a home in the flood plain across the street from his residence. The Chairman noted he had responded to the same inquiry several months earlier, at which time he contacted the Army Corps of Engineers and provided the relevant requirements for building in a flood plain/floodway, including that insurance rates would be more costly. Because the earlier response appeared to have been forgotten, the Chairman provided copies of the original information again. Attorney Pratt added that additional measures are needed to allow construction in a floodway, that FEMA may alter its maps upon application, and suggested the inquirer engage an engineer familiar with flood plain/floodway development to ensure all requirements are met.

Other

  • The Chairman and Board extended congratulations to a resident on her recent reappointment to the Capital District Regional Planning Commission.
  • Chairman McDonough asked whether future meetings would be virtual or in person. Attorney Pratt noted the amendments to the Public Officers Law permitting virtual public meetings were effective through January 15, 2022, with further legislation expected. The Chairman observed that the agenda would dictate the format for the next meeting, and that a virtual meeting might be appropriate if there was no business, so long as virtual meetings remained permitted.
