Office of the Zoning Board of Appeals, Town of Schaghticoke — December 2, 2021. The Board met via Zoom videoconference under amendments to the New York State Public Officers Law. Deputy Town Attorney Kristin Pratt explained the Zoom procedure, noted the meeting notice was posted in the newspaper, that the meeting was being recorded (to be posted to the town website and transcribed later), and that minutes were being taken; she also advised attendees to remain muted unless speaking.

Regular meeting
Chairman Ed McDonough opened the meeting at 7:30 PM with roll call. Present: Ed McDonough (Chairman), Rich Geddis, Kristin Griswold, Lettie Saheim, and Jason Shover. Absent: none. Deputy Town Attorney Kristin Pratt and Clerk Elizabeth Hale were also present.

Subdivision inquiry — 1722 NYS Route 40
Chairman McDonough relayed an inquiry from Albie Lewis, of Valley Paving, who owns a roughly 1.4-acre lot with an existing residence and garage at 1722 NYS Route 40. The lot has two septic systems (one serving each structure) and a single shared well. Mr. Lewis would like to subdivide the property to sell a section of the lot and the garage to the landscaper currently renting the garage for a landscaping business; another party expressed interest in purchasing the house. Chairman McDonough explained the required process — a survey, Rensselaer County Health Department approval for an additional well, and application to the Planning Board for the subdivision. Mr. Lewis indicated he did not wish to be burdened with an extensive project and said he may instead choose to sell the lot in its entirety.
Chairman McDonough asked Attorney Pratt whether future meetings would be virtual or in person. She noted the current amendments to the NYS Public Officers Law permitting virtual public meetings are effective through January 15, 2022, and that future meetings would likely follow a hybrid model allowing in-person or virtual participation. Chairman McDonough stated the agenda would dictate the decision for the next meeting, and with no business a virtual meeting might be more appropriate.
