Regular meeting

Chairman Ed McDonough opened the meeting at 7:30 PM with roll call. Present: Ed McDonough (Chairman), Rich Geddis, Lettie Saheim, and Jason Shover. Absent: Kristin Griswold. Deputy Town Attorney Kristin Pratt was present.

Anthony and Kristen Leonardi — area variance (Tax Map Parcel #20.18-2-6)

Anthony and Kristen Leonardi appeared to present an area variance application for a proposed 24-by-40-foot garage at 129 South Linden Avenue, Mechanicville, NY, in the Hamlet zoning district. They submitted a written application in advance and shared photographs of the property. The Board noted that under Section IV(F)(2)(c) of the Zoning Code, an accessory structure may not exceed the height of the principal structure and may not be set back less than 10 feet or the height of the accessory structure, whichever is greater. The proposed garage is 12 feet high and would sit 4 feet from the rear property line, so a rear-yard variance of 8 feet is sought.

Pruiksma — area variance (lot width)

Attorney Pratt stated that surveyor Brian Holbritter, L.S., had appeared before the Planning Board on August 4, 2021 to present a two-lot subdivision application, but was unable to attend the ZBA meeting due to a conflict. The applicant’s proposed subdivision map and Planning Board application were shared with the Board. The smaller parcel proposed for subdivision is approximately 174 feet wide where the Zoning Code requires 200 feet. Mr. Holbritter had also inquired whether a variance was required for lot area, but was likely referring to the Code section applicable to multifamily structures; the Board determined the only variance necessary is a lot-width area variance. Attorney Pratt said she would advise Mr. Holbritter of the necessary application.
