Office of the Zoning Board of Appeals, Town of Schaghticoke — February 4, 2021. The Board met via Zoom videoconference under the Governor’s Executive Orders. Deputy Town Attorney Kristin Pratt explained the Zoom procedure, noted the meeting notice was posted in the newspapers, that the meeting was being recorded (to be posted to the town website and transcribed later), and that minutes were being taken.

Regular meeting

Chairman Ed McDonough opened the meeting at 7:34 PM with roll call. Present: Ed McDonough (Chairman), Rich Geddis, Kristin Griswold, Lettie Saheim, and Jason Shover. Absent: none. Deputy Town Attorney Kristin Pratt and Clerk Elizabeth Hale were also present.

  • January 7, 2021 minutes approved as submitted (Shover · Griswold — Ayes: McDonough, Geddis, Griswold, Saheim, Shover; Nays: none).

Pre-application inquiries

  • Pole-mounted solar — 1150 River Road. Donald Jannicelli inquired about erecting pole-mounted solar panels on his land near the Turnpike Road intersection. Attorney Pratt e-mailed him links to the Zoning Code and the Solar Law so he could determine whether a variance application would be needed. He was invited to the meeting but did not attend.

  • Remodel Now, LLC — 850 NYS Route 40. Carl Godfrey left an application form with the Town Clerk and spoke with the Chairman and Attorney Pratt. He would like to locate his remodeling business, Remodel Now, LLC, in an RA district at 850 NYS Route 40 (just north of the old railway trestle in Melrose), in a building formerly used commercially as a plumbing business, without changing the footprint but adding a parking lot. Because his materials indicate an intent to rezone the property, Chairman McDonough advised him to approach the Town Board about rezoning from RA to Highway Commercial (HC); Attorney Pratt put him in contact with Supervisor Salisbury and Town Attorney Dave Brennan to begin the process.

  • Attached garage — 2 Powers Lane. An inquiry (dated January 11) concerned constructing a garage attached to a house 5 feet from the property line in an RA district, which requires a 25-foot side-yard setback. Because a 20-foot side-yard variance is substantial, Chairman McDonough asked whether the garage could be sited elsewhere or additional land purchased from the adjacent landowner to reduce or eliminate the variance.

  • Hudson River waterfront lot. Tom Chenaille contacted the Chairman about a 100-by-100-foot parcel on the Hudson River, where a prior building (possibly a garage) had been lost to fire; he would like to construct a small house on the waterfront. The Chairman sent him the ZBA application and related materials.
