Office of the Zoning Board of Appeals, Town of Schaghticoke — March 5, 2020. The Board met at the Town Hall, 290 Northline Drive, Melrose. The meeting opened at 7:30 PM with roll call.
Present: Ed McDonough (Chairman), Jason Shover. Absent: Rich Geddis, Kristin Griswold, Lettie Saheim. Deputy Town Attorney Kristin Pratt was present; Clerk Elizabeth Hale was absent.
Regular meeting / ZBA office hours
There was no quorum to conduct business. The only matter requiring Board action was adoption of the February 2020 minutes, which was carried over to the April 2020 agenda. The two members present held ZBA office hours to answer questions and discuss inquiries.
River Road inquiry (2754 River Road)
A resident of River Road appeared with a family member to discuss building a single-family residence for the family member on his roughly 1.385-acre parcel. The Rensselaer County Health Department had approved a septic design. The members noted the parcel well exceeds the minimum lot area per dwelling unit in the Zoning Code, so the lot size is conforming; provided other dimensional requirements can be met, the next step is to apply for a building permit.
Cold-storage inquiry — Route 40 near Campbell Road (Tax Map #41.-1-62 and #41.-1-62.2)
These parcels were recently rezoned from Residential Agricultural to Highway Commercial. The property owner asked Building Inspector Scott Frisino whether he could erect a 30’ × 61’ × 16’-high “cold storage” building on each parcel without ZBA or Planning Board review. Jason Shover indicated the Board would need to review the submitted building-permit application and learn more about the intended use before determining what approval is required. Chairman McDonough called Mr. Frisino during office hours to ask that the Board review the building-permit application and learn the planned use before making a determination.
