Office of the Zoning Board of Appeals, Town of Schaghticoke — August 1, 2019, at the Town Hall, 290 Northline Drive, Melrose. The meeting opened at 7:30 p.m.

Present: Ed McDonough (Chairman), Kristin Griswold, Lettie Saheim, and Jason Shover. Absent: Rich Geddis. Elizabeth Hale (Clerk) was present; Deputy Town Attorney Kristin Pratt was absent.

Regular meeting

  • July 11, 2019 minutes accepted as submitted (Saheim · Shover — Ayes: McDonough, Griswold, Saheim, Shover; Nays: none).

Frances Foley (Tax Map #41-1-77)

Applicant Frances Foley presented an application for an area variance to allow a 30×40-foot steel storage building/workshop/garage on a roughly 25-acre parcel in an RA district at 73 Weatherwax Lane; John Passelacqua was also present. The building would sit 15 feet north of the existing pond on a concrete slab. All setbacks would be met except the front-yard setback (proposed 25 feet where the Code requires 50 feet in an RA district). Ms. Foley explained that wetlands on the property and the land’s slope toward Weatherwax Lane limit the building’s siting, requiring the variance. Chairman McDonough assisted her with the application, reviewed the appeal process (including notice to residents within 500 feet), and explained the public-hearing sequence. Ms. Foley said she would submit the application, short-form EAF, and $150 fee to the Town Clerk promptly.

  • Motion to hold a public hearing on Application #3-19 (Frances Foley) on September 5, 2019 at 7:35 p.m. (McDonough · Griswold — Ayes: McDonough, Griswold, Saheim, Shover; Nays: none).

Other

  • Tiny-homes inquiry. A representative of Upstate Tiny Homes asked whether the Zoning Code had been changed to allow homes under 600 square feet. Chairman McDonough replied that no such change had occurred and that siting a tiny home would require an applicant to seek a variance from the ZBA.
  • Riley Road junk matter. A brief discussion took place on a Riley Road property; Chairman McDonough said he had visited multiple times and that it appeared to be in a worse state, with a larger collection of junk, than on prior visits.
