Regular meeting

Members present: Chairman Frank Alessandrini, Wayne Akin, Dan Clow, Brian Davidson, Robert Weir, and Scott Wiley. Elizabeth Hale was absent. Deputy Town Attorney Kristin Pratt was present.

  • April 3, 2019 minutes approved as submitted (Wiley · Clow — Ayes: Alessandrini, Akin, Clow, Wiley; Nays: none; Abstained: Weir). Brian Davidson arrived just after the vote.

Marten Lot Line Adjustment (Tax Map #31.-1-26.2)

The Board discussed the Marten lot line adjustment on Hansen Road in the RA district. Upon Mr. Marten’s review of the tax maps, a subdivision will be necessary: the proposal would subdivide about 3.78 acres from a 24.22-acre parcel, resulting in a 3.78-acre lot and a 20.44-acre lot. The Board will hold a public hearing on the subdivision at the June meeting.

Dormandy/Philpott/Peterson Lot Line Adjustment (Tax Map #14.-1-4.13, 14.-1-4.117, 14.-1-11.2)

Land surveyor Brian Holbritter presented an application to adjust parcels on the northwesterly side of Master Street, about 1,200 feet southwest of the intersection of Master Street and Schweinger Road in the RA district. The proposal would (a) annex about 0.40 acres from the Dormandy parcel to the Philpott parcel, and (b) annex about 12 square feet from the Dormandy parcel to the Peterson parcel to extend a 40-foot right-of-way through to Master Street. The Philpotts own about 8 acres with no road frontage, accessed via a 40-foot right-of-way on the Peterson property; the purchase of about 0.4 acres from Gary Dormandy would provide roughly 144 feet of road frontage. The Board noted the Philpott parcel is a pre-existing flag lot and that the proposal improves it by creating road frontage; it does not affect the pre-existing septic systems or wells.

Deer Park/Scheeren Lot Line Adjustments (Tax Map #11.-1-59, 11.-1-60, 11.-1-61, 11.-1-62, 11.-1-74)

Land surveyor Brian Holbritter presented lot line adjustments for 5 existing building lots in the Scheeren Deer Park subdivision on Partridge Street, in a wooded area of a Residential district off Verbeck Avenue. The applicant proposes to eliminate Lot #17 and a portion of Partridge Street to create 4 lots with increased acreage; the adjustments will create two flag lots with private driveways. The Board discussed whether the Fire Chief should be consulted about the roughly 300-foot driveway for proposed Lot #19 and ultimately decided consultation was unnecessary and that driveway-width conditions were not needed.

Other

  • Chairman Alessandrini raised a large sign erected on a property near Prospector’s Restaurant without a Special Use Permit; Code Enforcement Officer Brian Davidson said he would reach out to the Town Supervisor.
  • Reviewing the April Zoning Board of Appeals minutes, the Chairman noted that Thomas Martin’s area-variance application should also come before the Planning Board for a Special Use Permit, as the property is within the Flood Fringe Overlay District under Zoning Code Section VI(C). Kristin Pratt noted the application also requires a flood plain development permit and said she would advise the applicant.
  • The Board discussed a residence on Milky Way Road in the Hamlet District where a resident recently began repairing small engines, largely inside an existing garage; the resident recently moved in and was reportedly advertising on Facebook.

Administrative items

Kristin Pratt distributed the draft Zoning Revisions for review before submission to the Town Board.
