The meeting opened at 7:30 PM with roll call. Present: Ed McDonough (Chairman), Jason Shover, Rich Geddis, Kristin Griswold, Lettie Saheim. Absent: none. Deputy Town Attorney Kristin Pratt and Clerk Elizabeth Hale were present.

Regular meeting

  • Motion to open the meeting at 7:30 PM (McDonough · Geddis — Ayes: McDonough, Geddis, Griswold, Saheim, Shover; Nays: none).
  • November 1, 2018 minutes approved as submitted (Saheim · Griswold — Ayes: McDonough, Geddis, Griswold, Saheim, Shover; Nays: none).

The Chairman stated that no new applications were submitted, but there were inquiries.

Other

  • Possible subdivision — 3109 River Road (RA district). A resident contacted the Chairman about subdividing her ±1.27-acre property, which includes her residence and an existing accessory apartment. She had reviewed the idea with Planning Board Chairman Frank Alessandrini, who noted that subdividing ±0.27 acre off the ±1.27-acre lot would require substantial area variances, since the Code does not allow a lot this size to be subdivided in the RA district and the property already has an accessory apartment. He recommended she discuss requirements with ZBA Chairman McDonough. Mr. McDonough advised the variances would be substantial — density, front-yard, and both side-yard setbacks — and said he would not be in favor of such a substantial deviation, though he could not speak for the Board and she was free to apply.
  • “Stream of water” / buildability — North Linden Road and NYS Route 67 (Hemstreet Park HD). Building Inspector Don Bugbee relayed that a realtor, selling a 100′ × 200′ lot west of and directly across from the Mechanicville Golf Course, was concerned about a “stream of water” flowing through the property and asked its source (golf-course run-off, a creek, or a mapped water body requiring setbacks) to determine whether the lot is buildable. Attorney Pratt reviewed the Code’s definitions of water bodies and setbacks for mapped creeks and rivers with the Board. Chairman McDonough said he would observe the lot and water flow in daylight, try to determine the source, and respond to the realtor.
  • Pinehurst Street fence. The Chairman said he called a resident on Pinehurst Street about a 9.5-ft fence erected along the property line that violates the Code, but had received no response.
