Rubino Accessory Apartment — Special Use Permit (Tax Map #40.-1-1.15)
Opened at 7:30 PM. Applicant Joseph Rubino proposed an accessory apartment within a proposed garage at 2875 River Road (RA district), submitting an application, location maps, and exterior drawings. He had received a ZBA area variance for the garage and a building permit from Building Inspector Don Bugbee for a garage with storage and office space. No public comment. Closed at 7:33 PM.
Regular meeting
Members present: Chairman Frank Alessandrini, Wayne Akin, Brian Davidson, Dan Clow, Elizabeth Hale, and Robert Weir. The Chairman announced that Jack Walsh had retired from the Planning Board, praising his expertise, and the Board welcomed new member Scott Wiley. Deputy Town Attorney Kristin Pratt was present.
Rubino Accessory Apartment — decision
Applicant Joseph Rubino explained that he and his wife modified the original garage plan — dropping the office space to create an accessory apartment as living quarters for his recently widowed brother-in-law. The Rubinos own two adjacent River Road lots; the garage/apartment would be built on the lot contiguous to their residence. The Chairman advised Mr. Rubino to consult Building Inspector Don Bugbee on apartment-layout code, and noted the septic system needed County review; Mr. Rubino believed the 1250-gallon system (five 55’ laterals) serving his 2-bedroom home would suffice. He agreed to deliver the $100 fee to the Town Clerk.

The Chairman circulated a registration form for the 2018 Winter Planning and Zoning Schools (Minetto and Schoharie). He distributed a letter from James Nichols, Sr., manager/operator of the Eastside Marina, who acknowledged awareness of prior neighbor complaints from the period of former ownership, described his mitigation efforts, and offered to meet to resolve current and future issues.
