Public hearings

Della Rocco One-Lot Subdivision (Tax Map #40.-1-5)

Opened at 7:35 PM. Surveyor Brian Holbritter presented a 3.01± acre one-lot subdivision with existing dwelling and barn from an 85.42± acre parcel at Pinewoods and Sliter Roads; the surrounding land remains in crop (soybeans). The proposed flag lot has 58’ of Pinewoods Road frontage for access. No public comment. Closed at 7:39 PM.

DeMarco Accessory Apartment (Tax Map #30.-3-38)

Opened at 7:41 PM. Applicant Linda DeMarco presented her application for an existing 650 sq ft basement studio apartment at 3109 River Road (RA district), with living space, a half-wall-separated bedroom, kitchen and bath, and a direct walk-out exit. No public comment. Closed at 7:43 PM.

Convened at 7:40 PM. Members present: Chairman Frank Alessandrini, Wayne Akin, Brian Davidson, Dan Clow, and Elizabeth Hale. Jack Walsh and Robert Weir were absent. Deputy Town Attorney Kristin Pratt was present.

Della Rocco One-Lot Subdivision — decision

Surveyor Brian Holbritter represented applicant Paul Della Rocco. The flag-lot configuration preserves land for agriculture and future development; the existing dwelling has septic and well and 58’ of Pinewoods Road frontage. Application, short-form EAF, Agricultural Data Statement, maps, and a $180 check were received.

Applicant Linda DeMarco presented the 650 sq ft basement studio apartment for her son’s use in her 4-bedroom, 3-bath home at 3109 River Road (public water and sewer). The open plan has a half-wall bedroom, a large window, and a walk-out entrance. Rensselaer County left the decision to the local Board. Application, short-form EAF, and sketch plan were received; the $100 fee was paid to the Town Clerk.

Maloney & Roarke and Hipwell Boundary Line Adjustment (Tax Map #70.-3-1.115 & 70.16-1-22.1)

Surveyor Brian Holbritter represented applicant Michael Hipwell. Maloney and Roarke own a 66± acre parcel at the end of Malrick Road; in 2008 Mr. Hipwell bought a 0.78± acre lot from them between Sunset Drive and Malrick Road. Mr. Hipwell now seeks to add an adjacent triangular 0.09± acre parcel (owned by Maloney and Roarke, where he placed a shed), creating a 0.87± acre lot. A $25 fee was received.

Other

An earlier inquiry about a two-lot subdivision of an 8.29± acre Verbeck Avenue parcel (15’ and 80’ frontages) will not be pursued. The Chairman received a complaint about the operation of the Eastside Marina in Pleasantdale; Attorney Pratt will provide a decision to forward to those concerned. The August Zoning Code review meeting did not occur and was suggested to be postponed to October. The Board discussed adding a form letter explaining county finalization/filing steps (Department of Taxation and Finance stamping, RCHD, and Rensselaer County Clerk filing) to each decision, and clarified subdivision fee classification — a lot split from a “parent lot” counts as a one-lot subdivision, with further splits counted by the actual number of lots created.
