Zoning Board of Appeals, Town of Schaghticoke — Thursday, August 2, 2018, at the Town Hall, 290 Northline Drive, Melrose. The meeting opened at 7:34 PM with roll call.
Present: Jason Shover (presiding as Chairman), Rich Geddis, Kristin Griswold, Lettie Saheim. Absent: Ed McDonough, Chairman. Deputy Town Attorney Kristin Pratt and Clerk Elizabeth Hale were present.
Regular meeting
- June 7, 2018 minutes approved as submitted (Griswold · Geddis — Ayes: Shover, Geddis, Griswold; Nays: none; Abstention: Saheim).
Because there was no quorum of members who had also attended the July 2018 meeting, the Board could not consider or approve the July 5, 2018 minutes; they will be reviewed at the September meeting.
Fence inquiry — 1375 NYS Route 40 at Hansen Road (RA district). Building Inspector Don Bugbee appeared to discuss a resident’s possible application to erect a fence along the front of his property at the corner of Route 40 and Hansen Road; the resident did not appear and no application was submitted. The resident had told Chairman McDonough he wants a 5-ft solid stockade fence to keep highway debris off his property. Mr. Bugbee, Chairman McDonough, and the resident met at the site and measured the front-yard setback. Because sight distance for vehicles entering from Hansen Road may be an issue, they suggested setting the fence 5 ft from the road at the mailbox and 9 ft from the road at the telephone pole (nearer the corner) to improve visibility.
Reviewing Code Section IV(E) (corner lots) and Section V(G) (fences), the Board noted a height area variance would be required — the maximum fence height within 25 ft of a two-street intersection is 3 ft — and that the Code prohibits fencing that interferes with driver visibility. The Board also discussed winter snow-plow buildup potentially compromising the fence. Mr. Bugbee said he would stake and tape the proposed location to help the Board visualize the fence’s impact; if an application is submitted, the specific proposal will be reviewed.
