Zoning Board of Appeals, Town of Schaghticoke — April 5, 2018, at the Town Hall, 290 Northline Drive, Melrose. The meeting opened at 7:30 PM with roll call.
Present: Ed McDonough (Chairman), Rich Geddis, Kristin Griswold, Jason Shover. Absent: Lettie Saheim. Deputy Town Attorney Kristin Pratt and Clerk Elizabeth Hale were present.

- March 1, 2018 minutes approved as submitted (Griswold · Shover — Ayes: McDonough, Griswold, Shover; Nays: none; Abstention: Geddis).
Akin proposal — Application #3-18 (Tax Map #13.-1-53.1). Applicant Wayne Akin was not present but submitted an application to subdivide a ±2.01-acre lot from a ±4.2-acre parcel he owns at 285 Akin Road (RA district), intended as a future single-family building lot for his daughter. The Board reviewed the survey and determined the Code’s density requirements are not met: neither the subdivided lot nor the remainder would meet the minimum 3-acre density, so an area variance is required (approximately 0.99 acre for one parcel and 0.81 acre for the other). All setbacks to the proposed dwelling exceed 50 ft. The application, survey, and short-form EAF were submitted with a $150 fee.
- Motion to hold a public hearing on Application #3-18 on Thursday, May 3, 2018 at 7:35 PM (McDonough · Shover — Ayes: McDonough, Geddis, Griswold, Shover; Nays: none).
Other
- Agway store fence (Madigan Road / NYS Route 40, HC district). The owner of the Agway store under construction contacted the Chairman about erecting a roadside fence and a possible setback issue. Chairman McDonough measured the site and found the fence, as proposed, would sit about 30 ft from the roadway and meet Code.
- East Side Marina (Pleasantdale). The Chairman relayed that the East Side Marina was reportedly sold to the owner of a Ballston Lake marina, who may wish to expand it (gas sales, winter boat storage, a concrete ramp, a snack bar, and extended hours). The information was shared with the Planning Board Chairman and Building Inspector. No application has been filed with the Planning Board or the ZBA.
- Bentley Drive subdivision inquiry. The owner of a 5-acre R-district parcel on Bentley Drive would like to give his son a 2-acre lot for a single-family residence; no survey has been done, and he may need road-frontage and density variances. He indicated he might attend but did not appear.
- Riley Road property. The Chairman updated the Board on a Riley Road property with a garage built without a permit and excessive junk to be removed. Deputy Town Attorney Kristin Pratt has been working with the property owners’ counsel for several months to remedy the violations, but a settlement agreement had not been signed; the Town Board will decide next steps.
