Zoning Board of Appeals, Town of Schaghticoke — March 1, 2018, at the Town Hall, 290 Northline Drive, Melrose. The meeting opened at 7:31 PM with roll call.

Present: Ed McDonough (Chairman), Kristin Griswold, Jason Shover. Absent: Rich Geddis, Lettie Saheim. Deputy Town Attorney Kristin Pratt and Clerk Elizabeth Hale were present.

Regular meeting

  • February 1, 2018 minutes approved as submitted (Griswold · Shover — Ayes: McDonough, Griswold, Shover; Nays: none).

Bentley Drive subdivision inquiry. The Chairman relayed a referral from Planning Board Chairman Frank Alessandrini from a Town resident about subdividing a ±5-acre parcel into two lots in an R district on Bentley Drive. Mr. McDonough visited the site and believes an area variance would be required, as the Code’s density requirement would not be met. The resident was not in a hurry and did not appear; no application has been received.

Village trailer-sales business — code-enforcement update (30 South Main Street). Deputy Town Attorney Kristin Pratt updated the Board on the business at 30 South Main Street, whose owner is reported to have converted the commercial building into four or five residential units without permits or a Certificate of Occupancy. Town Attorney David Brennan brought suit and Rensselaer County Supreme Court issued an injunction barring the owner from renting additional units until certificates of occupancy issue. One tenant occupies a unit and is aware of the potential risk; a required sprinkler system had not been installed. A court order requires the owner to submit a building-permit application with plans to the Town Building Department, and an outside Building Inspector was retained. Asked about Town liability, Attorney Pratt said the Town’s active efforts to remedy the situation keep its risk low; no inspection had yet taken place.

Adirondack Rebar (Daniel Moreno, 196-228 Speigletown Road). The $300 application fee was returned to the applicant, with a cover letter from Attorney Pratt, because the materials needed to consider a use variance were not submitted.
